HB 2275 Summary

• Petition in error must be filed with Oklahoma Supreme Court Clerk within 30 days of judgment filing, or within 30 days after a copy is served on appellant if service was delayed beyond 3 days.

• Filing by delivery or mailing via certified or first-class mail is permitted, with postmark date or receipt date constituting the official filing date.

• Appellants may file a supplemental petition in error without additional costs if original petition was premature but the appeal deadline has now accrued.

• District court clerks must reject designations of record unless accompanied by signed acknowledgment from court reporter confirming transcript request or signed attorney statement explaining why no transcript was ordered.

• Counter-designations of record by appellees must similarly include either court reporter acknowledgment of additional transcript request or attorney statement that no additional transcript is necessary.

• Act becomes effective November 1, 2017.
