School districts, including technology school districts, may participate in, sponsor, conduct, or administer cooperative purchasing agreements with other public agencies for commodities and services, including joint contracts and open-ended state procurement contracts.

Local public procurement units (counties, cities, towns, state agencies, and other state subdivisions) may engage in cooperative or piggybacking purchasing agreements with other local public procurement units or external procurement units to access lower-priced products or services.

Purchases under cooperative agreements must comply with applicable procurement regulations including The Central Purchasing Act, the Public Competitive Bidding Act, the Finance Act, related administrative rules, and federal regulations based on funding sources.

State agencies remain obligated to adhere to statewide contracts issued by the state Purchasing Division and must utilize mandatory purchasing contracts designated by the State Purchasing Director.

The act becomes effective November 1, 2017.
