SB 649 Summary

• Amends Oklahoma sentencing law for second and subsequent felony offenses by replacing references to "State Penitentiary" with "custody of the Department of Corrections" throughout the statute.

• Prohibits use of prior convictions for possession of controlled dangerous substances (under Section 2-402 of Title 63) to enhance sentences under felony recidivism provisions.

• Adds new subsection E establishing a separate sentencing framework for defendants with prior non-violent felonies convicted of subsequent non-violent felonies, capping sentences at the maximum first-time offense sentence plus one-fourth.

• Clarifies that prior convictions for physical or sexually related child abuse may still be used for second and subsequent offender sentencing enhancements when the current charge involves child abuse.

• Effective date: November 1, 2017.
