SB 650 Summary

• Modifies 22 O.S. Section 18 to expand eligibility for criminal record expungement by revising categories 12 and 13 and adding two new categories (14 and 15)

• Category 12 (nonviolent felony): reduces waiting period from 10 to 5 years after conviction and shortens the misdemeanor-free lookback period from 15 years to 7 years

• Category 13 (up to two nonviolent felonies): reduces waiting period from 20 to 10 years after conviction and eliminates the requirement for full pardon on both offenses

• Adds category 14 for victims of identity theft who were charged or arrested for crimes committed by another using their name or identification without consent

• Adds category 15 allowing expungement with written consent from Oklahoma State Bureau of Investigation, arresting agency, and district attorney, with sealed records remaining accessible to law enforcement

• Effective date: November 1, 2017
