Courts must designate dissolution of marriage decree payments as either support or property division, with property division payments being irrevocable and not subject to modification.

Alimony terminates upon death or remarriage of the recipient, unless past-due support is claimed within 90 days of death or the recipient proves continued need for support within 90 days of remarriage.

Voluntary cohabitation of a former spouse with an opposite-sex partner is grounds to modify or terminate future support payments upon proof of substantial change in circumstances.

Special Monthly Compensation (SMC) awards from the U.S. Department of Veterans Affairs and service-related disability compensation cannot be considered in alimony or property division awards.

Military retirement and retainer pay may be divided using specified statutory formulas for active duty members (50% times fraction based on months of marriage service) and reserve members (50% times fraction based on reserve retirement points earned during marriage).

This act becomes effective November 1, 2017.
