Amends 40 O.S. 2011, Section 502 to establish that smoking and tobacco use restrictions qualify as bona fide occupational requirements for health care employers.

Exempts smoking restrictions from Sections 11 through 14 of the act when they relate to bona fide occupational requirements or collective bargaining agreements prohibiting or allowing off-duty tobacco use.

Defines restrictions on smoking or other tobacco product use as a bona fide occupational requirement when an employee works for an employer whose principal business is the provision or promotion of health care.

Takes effect November 1, 2017.
