SB 723 Summary

• Expands criminal background check requirements for child care facility owners, employees, and residents to include national criminal history records searches, sex offender registry checks, child abuse and neglect registry searches, and worker abuse registry searches.

• Extends the lookback period for criminal history records and sex offender registry searches from 3 years to 5 years for individuals who have lived outside the state.

• Requires national criminal history records searches based on fingerprints to be conducted by the Oklahoma State Bureau of Investigation and Federal Bureau of Investigation with rap back notification capabilities for subsequent criminal activity.

• Prohibits individuals who refuse to consent to criminal background checks or knowingly make false statements from owning, being employed by, or residing in a child care facility.

• Establishes penalties for violations including emergency orders, license revocation, administrative fines up to $10,000, injunctive proceedings, and criminal referrals; individuals required to register as sex offenders who violate the act face up to 5 years imprisonment and $5,000 fines.

• Effective November 1, 2017.
