State Board of Health shall establish policies and procedures for pre-licensure and re-licensure inspections of abortion facilities, with the Department conducting on-site inspections prior to issuing or reissuing licenses.

Board shall promulgate rules for conducting inspections and investigations of abortion facilities based on complaints received by the State Department of Health.

State Commissioner of Health and designated personnel may enter and inspect abortion facilities during regular business hours if there is reasonable cause to believe non-compliance with abortion regulations, fire ordinances, or other applicable laws.

License applications for facilities performing abortions constitute permission for and acquiescence to inspections during the application pendency and throughout the license term.

State Commissioner may deny, suspend, revoke, or refuse to renew an abortion facility license if inspections reveal non-compliance with applicable regulations and requirements.
