Hospitals, general medical surgical hospitals, specialized hospitals, critical access hospitals, emergency hospitals, and ambulatory surgical centers must submit to the State Department of Health beginning September 30, 2018, and annually thereafter information on the 100 most common medical procedures and 50 most common imaging procedures by volume, including CPT and HCPCS codes.

Facilities must also submit average dollar amounts billed to private insurers and average reimbursement amounts received from private insurers for each procedure listed above, utilizing electronic health records software.

Hospitals and ambulatory surgical centers must provide this pricing information in writing to patients or their legal guardians upon request.

Facilities must inform patients of their right to obtain this pricing information at the earliest reasonable and practicable time after admission.

Information provided under this act shall not be construed as an invoice, contract, or contractual agreement; the State Board of Health shall promulgate rules to implement the provisions.

Act becomes effective November 1, 2017.
