Senate Bill 766 Summary

• Establishes a "combined fee" for prepaid wireless telecommunications combining the 9-1-1 fee ($0.75) and Oklahoma Universal Service Fund (OUSF) charge into a single transaction amount collected from consumers at point of sale.

• Imposes monthly 9-1-1 fees of $0.75 on wireless telephone connections, VoIP services, and a per-transaction $0.75 fee on prepaid wireless retail sales beginning January 1, 2017.

• Requires retailers to collect the combined prepaid wireless fee from consumers and remit to Oklahoma Tax Commission using sales tax procedures; sellers retain 3% and Tax Commission retains 1% of collected fees.

• Converts the OUSF charge for prepaid wireless from a percentage-based to a flat dollar amount by multiplying the Commission-approved rate by the FCC "safe harbor" percentage and $25.00, with rate changes limited to once per calendar year on July 1.
