All nursing facilities, assisted living centers, residential care homes, and specialized facilities must have an emergency evacuation plan coordinated with and filed at the local emergency management agency and the State Department of Health.

All nursing facilities shall have emergency power generators available on-site that are reserved exclusively for the emergency electric system with sufficient kilowatt capacity for the respective facility.

Facilities without emergency generators or a written disaster plan must provide written disclosure to residents or their caregivers upon admittance stating the facility lacks either a generator or disaster plan.

The State Board of Health may promulgate rules necessary to implement provisions including requirements for disclosure and enforcement.
