Senate Bill 1791 Summary

• State Legislature preempts all state and political subdivision legislation that infringes on the right to keep and bear arms as guaranteed by the Second Amendment and Oklahoma Constitution Article II, Section 26.

• Any federal, state, county or municipal act, law, executive order, administrative order, court order, rule, policy or regulation ordering buy-back, confiscation or surrender of firearms, firearm accessories or ammunition from law-abiding citizens is declared an infringement on Second Amendment rights.

• Individuals acting on behalf of any political subdivision shall not engage in voluntary buy-back of firearms; violation is a misdemeanor punishable by up to one year in county jail and a fine equivalent to incarceration costs.

• Courts and law enforcement agencies are required to protect law-abiding citizens' rights to keep and bear arms within Oklahoma and defend against infringements described in the act.

• Preemption includes regulations under the National Firearms Act of 1934 and Gun Control Act of 1968 prohibited or regulated on or after the effective date; act becomes effective November 1, 2024.
