HB 1010 Summary

• Creates the "Presidential Preference Primary Modernization Act of 2025" and amends 26 O.S. 2021, Section 20-104 regarding candidate certification and delegate voting in presidential primaries.

• Requires the Secretary of the State Election Board to calculate and invoice political parties for all state costs incurred when delegates cast votes for a candidate other than the one who received Oklahoma's primary vote (excluding cases where the candidate died or was declared disabled under the 25th Amendment).

• Invoice must include detailed accounting of administrative expenses, ballot printing, and election staffing costs, with political parties required to remit full payment within 90 days; failure to pay results in ineligibility of that party's candidates in the subsequent presidential primary.

• Permits state central committees to appeal invoices within 30 days of receipt, with the State Election Board required to conduct hearings and issue a written decision with any modifications within 60 days.

• Becomes effective November 1, 2025.
