HB 1060 Summary: Oklahoma Uniform Easement Relocation Act of 2025

• Enacts the Oklahoma Uniform Easement Relocation Act of 2025, codified in Title 60, Sections 1501-1514 of the Oklahoma Statutes

• Allows property owners (servient estate owners) to relocate easements through civil court action if the relocation does not materially lessen utility, increase burden on the easement holder, impair safety, disrupt use, or impair property values

• Excludes public-utility easements, conservation easements, negative easements, and easements by consent from relocation eligibility

• Requires servient estate owners to pay all reasonable relocation expenses, including construction, permits, title work, and maintenance costs greater than the original easement

• Makes the relocation right non-waivable through agreement and applies the law retroactively to easements created before, on, or after the effective date of November 1, 2025
