Medical records must be retained for a minimum of 10 years after the patient's last visit or 3 years after the patient's death.

Records for newborns and minors must be retained for 3 years past the age of majority.

Health care providers may use microfilm, optical disk, or similar technology to record medical records and destroy originals to conserve space, with reconstituted records considered equivalent to originals for compliance purposes.

Health care providers must notify the State Department of Health about record disposition upon office closure, with records protected and retained consistent with statute of limitations.

The act becomes effective November 1, 2025.
