HB 1109 Summary

• Prohibits detention of children for violations of court orders compelling school attendance, and prohibits placement in detention solely for truancy or noncompliance with mandatory attendance laws.

• Requires written notice to parents after 5 unexcused absences and mandates school districts adopt three-tiered progressive truancy intervention plans by November 1, 2025, before referring cases to court.

• Tier one requires attendance conferences and contracts; tier two requires individualized assessment and referral to counseling or services; tier three includes school-based community services or restorative justice programs.

• Prohibits suspension (in-school or out-of-school) as a truancy intervention and allows courts to dismiss complaints if schools fail to comply with intervention plan requirements.

• Allows fines imposed for educational neglect violations to be waived upon successful completion of court-ordered conditions and substantial compliance with school attendance requirements; effective July 1, 2025.
