Publicly funded school districts must obtain proof of U.S. citizenship or legal immigration status from parents, guardians, or emancipated minors at student enrollment through one of ten specified documents (birth certificate, passport, driver license, identification card, naturalization certificate, citizenship certificate, consular birth report, permanent resident card, employment authorization card, or foreign passport with U.S. visa stamp).

Each school district must record the citizenship status of all enrolled students, including those who fail to provide proof of citizenship or legal immigration status.

School districts must submit annual reports to the State Department of Education containing the number of students who provided proof of U.S. citizenship, provided proof of legal immigration status, or failed to provide either, excluding any personally identifiable information.

Nothing in this law prohibits or inhibits any child from receiving education they are entitled to under state or federal law.

The act becomes effective July 1, 2025, with an emergency declaration allowing immediate implementation upon passage and approval.
