HB 1166 Summary

• Municipalities with population of 12,000 or less may only annex up to 8 square miles in one area at a time if they obtain written consent of at least 65% of acreage owners and 25% of population to be annexed.

• Municipalities must prepare and provide a service plan for extending water, sewer, fire protection, law enforcement and other municipal services before annexing territory without majority owner consent, with completion required within 120 months unless a different timeframe is agreed upon.

• Property owners may petition for detachment if a municipality fails to substantially complete promised services, requiring only majority owner consent rather than three-fourths consent for service-failure detachments under Section 21-103.

• Municipalities are prohibited from attaching ad valorem taxes to annexed areas for sinking funds to satisfy judgments if the annexed area was not part of the municipality when the judgment was rendered.

• Owners of land detached from a municipality are prohibited from petitioning for re-annexation to that same municipality for ten years after detachment.
