Police officers and sheriffs cannot release persons arrested for second or subsequent DUI violations without bail granted by a magistrate, court, or judge, whether by telephone or in person.

Courts must consider the threat posed to public safety when determining bail for DUI arrests and must present written findings on the bail amount.

Removes requirement for drug and alcohol testing in traffic accidents resulting in immediate death or great bodily injury; timing requirements for certain DUI tests do not apply to intoxicating substances other than alcohol.

Modifies blood withdrawal authorization procedures to include written statements from peace officers regarding arrests for DUI causing death or serious physical injury, or traffic accidents resulting in death or great bodily injury.
