HB 1255 Summary

• Beginning with the 2025-2026 school year, private school and homeschool students whose families claim the Oklahoma Parental Choice Tax Credit must complete statewide assessments at a state-certified testing facility during the established assessment window.

• Assessments administered to private and homeschool students shall include English Language Arts, Mathematics, Science, and United States History (with civics emphasis) as required by the statewide student assessment system.

• If a student declines to complete the required assessments, the taxpayer claiming the tax credit must repay that credit to the Oklahoma Tax Commission within 60 days after the assessment window concludes.

• The State Board of Education shall promulgate rules establishing assessment window dates and ensuring results are reported to districts in a timely manner with preliminary results provided by June 20 of each year.

• The bill becomes effective July 1, 2025, with an emergency clause allowing it to take effect immediately upon passage and approval.
