Beginning with the 2025-2026 school year, each school district board of education must spend at least 50% of its annual budget on instructional expenditures.

School districts spending less than 50% on instructional expenditures must increase that spending by a minimum of 2% annually until reaching the 50% threshold.

Districts failing to meet the 2% annual increase requirement receive a written warning notice from the State Department of Education, which must also be posted on the district's website.

After 4 consecutive years of non-compliance, school districts must provide permanent 2% pay increases to all teachers for each year the minimum 2% instructional expenditure increase was not met.

"Annual budget" includes revenues from local, state, and federal sources but excludes bond sales, property/equipment sales, fundraisers, and nonprofit contributions; "instructional expenditures" uses the National Center for Education Statistics definition.
