HB 1300 Summary

• Amends 26 O.S. 2021, Section 7-116.1 to allow absentee voters to cast in-person provisional ballots on election day at their assigned polling place or an in-person absentee voting site if their absentee ballot was not received by the county election board by election day or was rejected.

• Provisional ballots cast by absentee voters shall only be counted if the county election board secretary confirms that the absentee ballot was not received by the statutory deadline or was rejected.

• Creates new law Section 14-134.1 of Title 26 establishing the procedures and conditions for absentee voters to cast provisional ballots during the in-person absentee voting period.

• Requires all provisional ballot materials to be retained by county election boards for 24 months after the election date.

• Effective date: November 1, 2025.
