HB 1308 Summary

• Prohibits prohibited foreign parties and foreign-party-controlled businesses from acquiring real property or agricultural land in Oklahoma; violators have 2 years to divest or face judicial foreclosure and felony charges up to 2 years imprisonment and $15,000 fine.

• Defines "prohibited foreign party" to include citizens/residents of countries subject to International Traffic in Arms Regulations, foreign governments, entities organized under foreign government laws, U.S.-organized entities with significant foreign control, and entities designated by the U.S. Department of State.

• Establishes affirmative defense for resident aliens; requires all recorded deeds to include sworn affidavits attesting compliance with foreign ownership restrictions and Attorney General promulgation of separate affidavit forms for individuals and business entities.

• Creates Office of Agricultural Intelligence within Oklahoma Department of Agriculture, Food, and Forestry to collect information on unlawful foreign agricultural land possession, report violations to Attorney General, and enforce provisions of the act under Secretary direction.

• Repeals prior foreign land ownership statutes (60 O.S. 2021, Sections 121-127) and becomes effective November 1, 2025.
