HB 1361 Summary

• Defines "assigned sex at birth" as XX or XY chromosomes documented on a valid birth certificate and "school personnel" as faculty, teachers, employees, and contractors of public schools acting within their duties.

• Prohibits school personnel from asking students to use pronouns or alternate names inconsistent with biological sex, asking about preferred pronouns, or referring to students by such pronouns without written parental permission.

• Prohibits students from requesting school personnel use pronouns or alternate names inconsistent with the personnel's assigned sex at birth, or asking about preferred pronouns, without written parental permission.

• Exempts school personnel and students with genetically verifiable disorders of sex development, including aneuploidy, XX or XY sex reversal syndromes, and ovotesticular disorder.

• Requires school administrators to notify parents or legal guardians of all involved students within 24 hours of learning of violations and allows disciplinary action against violating school personnel, including teacher license suspension or revocation, contract cancellation, or termination.

• Effective July 1, 2025, with emergency clause for immediate effect upon passage and approval.
