Establishes that aliens unlawfully present in Oklahoma after being arrested for any state criminal offense are guilty of a felony punishable by imprisonment in the Department of Corrections for not less than five (5) years.

First offense of unlawful entry and presence is a misdemeanor punishable by up to one (1) year in county jail or a $500 fine, requiring the person to leave the state within 72 hours after conviction or release.

Persons arrested under this section may post a cash bond of not less than $35,000, and courts may dismiss prosecution if the person agrees to return to their country of origin, has no prior violent crime convictions, and is not charged with another felony.

Requires the Department of Corrections to notify U.S. Customs and Border Protection within seven (7) days to arrange repatriation when a person is remanded to their custody.

Preempts all local ordinances and regulations conflicting with the act's provisions and declares an emergency, making the act effective immediately upon passage and approval.
