HB 1453 Summary

• Prohibits prohibited foreign parties and foreign-party-controlled businesses from acquiring real property or agricultural land in Oklahoma, with violators having one year to divest before Attorney General enforcement and judicial foreclosure.

• Defines "prohibited foreign party" to include citizens/residents of countries subject to International Traffic in Arms Regulations, foreign governments from those countries, entities controlled by such parties, and U.S. Department of State-designated Entities of Particular Concern.

• Creates affirmative defense allowing resident aliens to own property and agricultural land under the same terms as U.S. citizens, but must divest within one year if they lose resident alien status.

• Establishes the Office of Agricultural Intelligence within the Oklahoma Department of Agriculture, Food, and Forestry to investigate violations and report to the Attorney General, who may issue subpoenas and commence legal actions for foreclosure.

• Requires all deeds recorded after the effective date to include an affidavit from the buyer attesting compliance with the foreign ownership restrictions; violators face felony charges punishable by up to two years imprisonment and/or $30,000 fine; effective November 1, 2025.
