HB 1460 Summary

• Eliminates various criminal case fees including DNA analysis fees ($150), laboratory analysis fees ($150), and application fees for indigent defense ($40) that were previously collected and deposited into state revolving funds

• Authorizes courts to waive prosecution costs under certain circumstances by allowing equal percentage reductions across fines, costs, and prosecution costs, and waives unpaid prosecution costs if sentences expire unrevoked

• Requires courts to assess batterers for evaluation through certified treatment programs when sentencing persons convicted under Section 644 of Title 21

• Modifies sentencing provisions in 22 O.S. 2021 Section 991a and 991c to remove references to specific fee collections while maintaining other sentencing conditions and authority

• Becomes effective November 1, 2025
