HB 1578 Summary

• Amends 49 O.S. 2021, Section 113 regarding notarial officer duties for acknowledgments, verifications, witnessing, certifying, and protests of negotiable instruments.

• Changes the criminal penalty for notaries who perform notarial acts without properly determining the identity of the person appearing before them from a misdemeanor to a felony.

• Increases the maximum fine from $1,000 to $5,000 and extends the maximum jail sentence from 10 days to 30 days for violations.

• Becomes effective November 1, 2025.
