Election board shall select nominee or electee by public lot drawing when a tie vote is certified in Runoff Primary, General Election, or Primary Election.

Election board secretary must notify tied candidates by registered or certified mail at least 5 days before the drawing, including time, date, and location of the selection.

Each tied candidate may designate one witness to attend the drawing; candidate names are written on equal-sized papers, placed in separate opaque containers, and tumbled in a transparent container before one is randomly drawn to determine the winner.

When three or more candidates tie for first place at a Primary Election with a scheduled Runoff Primary, all tied candidates shall be placed on the Runoff Primary ballot instead of using the lot drawing procedure.

Procedures do not apply to elections of state officers under Section 5 of Article VI of the Oklahoma Constitution; act becomes effective November 1, 2025.
