HB 1688 Summary

• Adds definition of "minor correction" to vital statistics law, allowing scrivener's errors, spelling corrections, and omissions to be fixed with clear and convincing evidence of objective error knowable at or near the time the certificate was made.

• Changes statutory references throughout Title 63 from "State Registrar of Vital Statistics" to "Commissioner of Health" or "State Department of Health" for administrative clarity.

• Specifies that biological sex designation on birth certificates must be either male or female and cannot be nonbinary or any symbol representing a nonbinary designation including the letter "X".

• Extends the timeframe for funeral directors to request death certificate corrections from sixty (60) days to one (1) year after initial issuance for scrivener's errors and misspellings, excluding medical certification information.

• Becomes effective July 1, 2025, with an emergency clause allowing immediate effect upon passage and approval.
