HB 1689 Summary

• Amends Oklahoma's larceny statute for lost property (21 O.S. 2021, Section 1702) with four graduated penalty tiers based on property value: under $1,000 (misdemeanor, up to 1 year jail or $500 fine); $1,000-$2,499 (felony, up to 2 years DOC or 1 year jail or $1,000 fine); $2,500-$14,999 (felony, up to 5 years DOC or 1 year jail or $1,000 fine); and $15,000+ (felony, up to 8 years DOC or $1,000 fine).

• Makes unlawful the removal of a shopping cart from a retail establishment's parking area with intent to permanently or temporarily deprive the owner of its use.

• Makes unlawful the possession of a shopping cart removed from a retail establishment's parking area with intent to permanently or temporarily deprive the owner of its use.

• Shopping cart violations are misdemeanors punishable by up to 1 year in county jail, a fine up to $1,000, or both.

• Effective date is November 1, 2025.
