HB 1726 Summary

• Prohibits land application, spreading, sale, and distribution of sewage sludge, biosolids, septage, and compost containing these materials in Oklahoma, with exceptions for lined landfill disposal and products from food processing, fermentation, distilling, and animal manure sources.

• Establishes civil liability for any actions after the effective date that result in PFAS (perfluoroalkyl and polyfluoroalkyl substances) contamination from biosolids land application, with recovered funds used for remediation of affected lands, crops, livestock, waters, and human health impacts.

• Requires Department of Environmental Quality to submit a long-term plan by December 1, 2025 addressing septage prohibition and alternative safe processing methods for biosolids and sewage sludge.

• Directs Oklahoma Department of Agriculture, Food, and Forestry to develop a comprehensive plan by December 1, 2025 to protect impacted agricultural producers from PFAS contamination, with estimated remediation costs to be included in the next fiscal year appropriations bill.

• Requires development of policies providing state and federal funding for water treatment infrastructure to remove PFAS, voluntary testing and investigation, and financial assistance and medical monitoring for impacted families and communities.
