HB 1938 Summary

• Beginning in the 2025-2026 school year, each school district must conduct an annual fitness assessment approved by the State Board of Education for students in grades 3-12 as part of required physical education courses.

• The assessment instrument adopted by the State Department of Education must measure aerobic capacity, body composition, and muscular strength/endurance/flexibility, with standards specific to student age and gender based on health benchmarks.

• School districts must annually report assessment results to the State Board of Education and Department of Health without identifying student names or Social Security numbers, and provide clear results to parents by the last day of the school year.

• The State Department of Education and Department of Health must analyze results to identify correlations with student obesity, attendance, academic achievement, disciplinary problems, and school meal programs.

• The State Board of Education shall submit annual compliance reports to the Governor beginning October 1, 2026, and the Governor may establish recognition programs to acknowledge districts and schools with the most improvement in fitness assessments.
