HB 1964 Summary

• Establishes private right of action allowing parents to sue schools for damages if their child is harmed by violations of parental rights provisions in Section 2003.

• Requires school districts to develop policies enabling parents to review learning materials, budget expenditures, contracts, and information about all school programs and activities.

• Allows parents to object to and withdraw children from any academic or nonacademic material, activity, or instruction deemed harmful, including content related to sex, morality, religion, race, gender identity, or sexuality.

• Requires parental written consent for children's participation in sex education, classroom activities promoting ideological beliefs, diversity/equity/inclusion programs, social-emotional learning programs, and certain data collection instruments or surveys.

• Establishes $1,000 per violation fine for school violations and expands the definition of mental health therapy requiring parental consent to include gender-affirming care, transitioning information, and sexual identity-related school communications; effective November 1, 2025.
