HB 1982 Summary

• Amends Section 16-106 of Title 70 (Oklahoma Statutes) to require publishers to stipulate in state textbook contracts that all electronic materials furnished in lieu of or bundled with physical textbooks are ready for use or will be ready by the date of delivery.

• Creates new Section 16-201 requiring all contracts between vendors and schools for electronic educational materials (including digital textbooks, software, and online access) to include provisions ensuring materials are ready for use by delivery date and defective materials are replaced within 7 calendar days at no cost.

• Authorizes school districts to immediately terminate vendor contracts and disqualify vendors from future contracts for violations of the new requirements, with vendors subject to damages and penalties as provided by law.

• Requires publishers under State Textbook Committee contracts to provide electronic files in formats prescribed by federal law or, if no federal standard exists, by the State Department of Rehabilitation Services to enable production of Braille and other accessible versions.

• Effective date is July 1, 2025; an emergency clause allows the act to take effect upon passage and approval.
