HB 1987 - Oklahoma Extreme Risk Protective Order Act

• Creates the Oklahoma Extreme Risk Protective Order Act establishing procedures for obtaining emergency and six-month firearms restraining orders against individuals posing danger to themselves or others.

• Allows intimate partners, family/household members, and law enforcement officers to petition district courts for restraining orders; requires courts to hold emergency hearings within one day and full hearings within 14 days.

• Authorizes courts to issue search warrants for seizure of firearms and handgun licenses upon finding probable cause, with seized firearms held by law enforcement and returned upon order expiration if recipient is lawfully eligible.

• Requires clear and convincing evidence at hearings for six-month orders; respondents entitled to one termination hearing during order period; orders renewable for additional six-month periods upon demonstration of continued danger.

• Repeals the existing Anti-Red Flag Act (21 O.S. 2021, Sections 1289.24b and 1289.24c); becomes effective November 1, 2025.
