HB 2048 Summary

• Creates the 340B Nondiscrimination Act prohibiting health insurers, pharmacy benefits managers (PBMs), and third-party payors from discriminating against 340B entities through lower reimbursement rates, additional fees, or restrictions on pharmacy network participation based on 340B drug pricing status

• Prohibits manufacturers and distributors from interfering with acquisition or delivery of 340B drugs to covered entities and requires 340B entities to contract with willing pharmacies within a fifteen-mile radius without limiting the number of contracted pharmacies

• Establishes enforcement authority split between the Insurance Department (for health insurers) and Attorney General (for PBMs and other entities), each authorized to levy civil fines of $100 to $10,000 per violation

• Amends the Patient's Right to Pharmacy Choice Act to add 16 new prohibitions on PBMs regarding 340B drug pricing discrimination, require drug formulary decisions based on normal business practices not 340B status, and mandate quarterly reporting of rebates and pricing data to the Attorney General

• Effective November 1, 2025; does not apply to Oklahoma Medicaid program when Medicaid provides reimbursement for covered drugs
