HB 2088 Summary

• School district boards of education must adopt a policy beginning in the 2025-2026 school year allowing students educated by other means to participate in extracurricular activities offered by their resident district, with policies published in student handbooks and on district websites.

• Students educated by other means must register by July 1 preceding the school year, pay equal participation fees, adhere to the same behavior and conduct standards, follow school athletic association rules, and comply with physical exams or drug testing requirements as other participants.

• Academic standards for participating students shall be met through an evaluation method agreed upon by the parent/legal guardian and the superintendent, which may include review by a certified teacher, performance on nationally recognized standardized tests, or evaluation of correspondence course grades.

• School athletic associations must adopt written policies allowing student participation under these provisions as a condition of membership for public schools and school districts, per amendments to Section 27-103 of Title 70.

• The act becomes effective July 1, 2025, with an emergency clause allowing immediate effect upon passage and approval.
