HB 2089 Summary

• Amends 27 O.S. 2021, Section 11 to expand eminent domain reimbursement provisions to include right-of-way acquisitions for oil and gas pipelines.

• Property owners may recover reasonable attorney, appraisal, and engineering fees when a condemnation proceeding is abandoned, property cannot be acquired by condemnation, or when a jury award exceeds the greater of the commissioners' award or the condemning authority's last written offer by at least 10%.

• Amends 66 O.S. 2021, Section 55 to add expert witness fees to the reimbursable costs and clarifies that the condemning party must pay all awarded sums to the property owner.

• Reimbursable fees must be actually incurred by written contract to qualify for reimbursement.

• Effective date: November 1, 2025.
