State Department of Education must publish federal guidance documents from the U.S. Department of Education on a designated website within 5 days of receipt, unless the document contains sensitive or confidential information protected by privacy laws.

State Department of Education must create the designated website within 90 days of the effective date and include conspicuous hyperlinks providing access to published guidance documents.

Rescinded federal guidance documents must be retained on the website with a notation indicating rescission status and the rescission date within 15 days of rescission by the U.S. Department of Education.

"Guidance document" is defined broadly to include federal agency statements of general applicability (memoranda, notices, bulletins, directives, letters, or no-action letters) designated by agency officials as setting forth policy or interpretation on statutory, regulatory, or technical issues, excluding rules with force and effect of law.

The act becomes effective November 1, 2025.
