• Requires applicants notify all surface owners, mineral owners, and adjacent owners (within 1/2 mile radius) at least 60 days prior to construction by U.S. mail and file affidavits with county clerks confirming compliance within 90 days.

• Sets penalties of $1,500 per violation per day for commencing operations without an approved permit or violating Commission rules, with filing fees capped at $40,000 per permit on a per-acre, per-turbine, per-megawatt, or other basis determined by the Commission.

• Requires existing or under-construction energy facilities to obtain permits by January 1, 2026, except those owned by public utilities which are exempt from permit fees; establishes emergency rules authority and declares the act immediately effective upon passage.
