HB 2168 Summary

• Amends 61 O.S. 2021, Section 83 to prohibit public agencies and construction managers from including certain terms in bid specifications, project agreements, or controlling documents for public improvement projects.

• Prohibits terms that require, prohibit, encourage, or discourage bidders, contractors, or subcontractors from entering into or adhering to agreements with collective bargaining organizations related to the construction project.

• Prohibits terms that discriminate against bidders, contractors, or subcontractors based on their status as a party or nonparty to collective bargaining agreements, or their willingness or refusal to enter into such agreements.

• Passed the House of Representatives on March 24, 2025.
