OK HB2171

Creates the Oklahoma Uniform Unlawful Restrictions in Land Records Act to allow property owners to record amendments removing unlawful restrictions based on race, color, religion, national origin, sex, familial status, disability, or other personal characteristics that violate state or federal law.

Permits individual property owners to file amendments removing unlawful restrictions from their property only, except for properties subject to governing instruments (homeowners associations).

Authorizes owners association governing bodies to amend governing instruments to remove unlawful restrictions without a member vote, with members able to request removal and the governing body having 90 days to determine and act on the request.

Requires amendments to identify the owner, affected property, and document containing the restriction, include a specific statutory statement, be executed and acknowledged like other land records documents, and be recorded with the county clerk where the original restriction is recorded.

County clerks must record amendments, add them to the index, cross-reference them to the original document, and are not liable for recording amendments; act becomes effective November 1, 2025.
