HB 2217 Summary

• Allows injured employees receiving vocational rehabilitation services to receive temporary total disability benefits at the same rate for an additional 52 weeks while actively participating in retraining or job placement programs, with possible extension for another 52 weeks if necessary.

• Requires the qualified vocational expert to submit regular updates at least every 13 weeks on employee participation, with continuation of benefits based on clear and convincing evidence of active program participation.

• Prohibits termination of vocational rehabilitation benefits without a Commission hearing order and allows permanent termination only after two or more benefit suspensions or if the employee abandons participation.

• Modifies attorney fee structure for vocational rehabilitation services to allow up to 10% of the total cost of vocational rehabilitation services, paid by the employer or insurer upon the employee's conclusion of services.

• Effective date: November 1, 2025.
