HB 2298 Summary

• Establishes independent prescriptive authority for Advanced Practice Registered Nurses (Certified Nurse Practitioners, Clinical Nurse Specialists, and Certified Nurse-Midwives) who complete 6,240 clinical practice hours with physician supervision.

• Requires Advanced Practice Registered Nurses with independent prescriptive authority or their employers to maintain malpractice insurance of at least $1,000,000 per occurrence and $3,000,000 annually in aggregate.

• Creates new regulations for supervising physicians, including requirements for written supervision agreements, eligible physician criteria, allowable supervision fees based on fair market value, and mandatory availability for consultation through direct contact or electronic means.

• Establishes a Formulary Advisory Council composed of physicians, pharmacists, and Advanced Practice Registered Nurses to develop exclusionary formularies and prescriptive standards for Advanced Practice Registered Nurses.

• Becomes effective November 1, 2025.
