Removes requirement that indigent defendants who are released on bond must contact three named attorneys and demonstrate inability to obtain private counsel before applying for public defense representation.

Establishes rebuttable presumption that defendants unable to post bail are eligible for Oklahoma Indigent Defense System appointment, with income above the state poverty threshold as a rebuttal factor.

Waives the $40.00 application fee and application requirement for defendants who qualify under the rebuttable presumption of eligibility.

Maintains existing procedures requiring applications to be sworn statements under penalty of perjury, with copies sent to prosecutors and ability to request eligibility hearings.

Takes effect November 1, 2025.
