HB 2705 Summary

• Requires investigating law enforcement agencies to inform sexual assault victims of the status of sexual assault forensic evidence upon request, with agencies allowed to require requests be submitted in writing.

• Grants sexual assault victims the right to be informed whether a DNA profile was obtained from forensic evidence, whether the DNA profile was entered into the Combined DNA Index System (CODIS) Database, and whether a confirmed match exists between the victim's DNA profile and profiles in the CODIS Database.

• Exempts law enforcement from disclosing evidence, information, or results that would impede or compromise an ongoing criminal investigation.

• Clarifies the statute is intended to encourage law enforcement to notify victims of information already in their possession, rather than creating new investigative obligations.

• Takes effect November 1, 2025.
