HB 2725 Summary

• Persons, wreckers, and towing operators removing wrecked or damaged vehicles from highways or accident sites must remove any glass or other injurious substances from the vehicle.

• Vehicle owners or their insurers (if the owner has minimum coverage as required by Section 7-324) are responsible for removal costs of the vehicle, glass, injurious substances, and storage fees, with rates set by the Corporation Commission for nonconsensual tows.

• Upon receipt of a removal claim, insurers must remit payment directly to the company providing the removal, with removal and cleanup fees constituting a special lien payable before any other claims.

• Truck-tractors carrying cargo must maintain commercial auto, farm and ranch, inland marine, or cargo liability insurance covering cleanup costs for substances spilled or deposited on roadways in violation of this section.

• Prohibition on throwing substances at standing vehicles, occupants, or persons on or adjacent to highways remains in effect.

• Effective date: November 1, 2025.
