HB 2820 Summary

• Expands Oklahoma's state firearms preemption to include firearm and ammunition components, making all local orders, policies, ordinances, resolutions, or regulations concerning these items null and void except as specifically permitted.

• Prohibits municipalities, agencies, and political subdivisions from adopting any orders, policies, ordinances, resolutions, or regulations concerning the sale, purchase, transfer, ownership, use, possession, carrying, transportation, licensing, permit, registration, or taxation of firearms, knives, firearm and ammunition components, and ammunition.

• Allows municipalities to adopt ordinances only regarding discharge of firearms within their jurisdiction, traffic citations for improper firearm transport, and citations for air-powered weapons misuse; also permits schools to regulate knife possession on school property.

• Enables aggrieved persons to bring civil actions against violating entities for injunctive relief or monetary damages after providing 90 days written notice to rescind the unlawful provision.

• Permits courts to award reasonable expenses including attorney fees, expert witness fees, and court costs if the aggrieved party prevails and the issue is governed by previously settled law; allows recovery of expenses even if the provision is rescinded after suit is filed.

• Declares an emergency, making the act effective immediately upon passage and approval.
