Counties, cities, and local government units may provide up to 5% local bid preference on public construction contracts exceeding $100,000 or construction management contracts exceeding $50,000, if the awarding agency determines there is economic benefit to the local area.

Local bid preference is only applicable when the local bidder is the second lowest qualified bid and must agree to perform at the same price and terms as the lowest nonlocal bidder.

Awarding agencies must adopt an established policy demonstrating the economic benefit to justify any local bid preference, and bid specifications must clearly state that the bid is subject to local bidder preference law.

Local bid is defined as a bidding person authorized to conduct business in Oklahoma and maintaining a bona fide establishment within the state.

The local bid preference provision does not apply to construction contracts utilizing federal funds when it would conflict with federal law or regulation, and the act becomes effective November 1, 2025.
